New York Assembly Bill 9328/Senate Bill 8889 (2022)

An act to amend the public authorities law and the state finance law, in relation to requiring certain funds received by the New York state energy research and development authority that are related to renewables development on viable agricultural lands to be used for farmland protection programs

This bill would provide that projects receiving NY-SUN incentive awards from the New York State Energy Research and Development Authority (NYSERDA) that site projects on farmland are required to pay a penalty to be deposited into the agricultural and farmland viability protection fund.
