An act to amend Section 678 of the Civil Code Sections 872.020 874.311 874.312 874.313 874.314 874.316 874.319 874.320 874.321 and 374.321.5 of to amend the heading of Chapter 10 (commencing with Section 874.311) of Title 10.5 of Part 2 of and to repeal Section 874.322 of the Code of Civil Procedure relating to property.

This bill would enact the Partition of Real Property Act, which would expand the scope of the Uniform Partition of Heirs Property Act to apply to any real property held in tenancy in common where there is no agreement in a record binding all the cotenants which governs the partition of the property.
